Terms of Service

These Terms govern your access to and use of thebroadwaydropshop.com and any purchases from The Broadway Drop Shop LLC (“we,” “us,” or “the Shop”). By using the Shop, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Shop.

Eligibility & accounts

You must be at least 18 years old, or the age of majority where you live, to make a purchase. You are responsible for the activity under your account and for keeping your login and chosen alias accurate and secure.

Drops, the queue & availability

Products are released as limited, timed “drops.” Access is managed through a virtual queue and reservations; a place in line or a reservation does not guarantee a purchase, and items may sell out. We may modify, pause, or cancel a drop at any time.

Pro membership

Pro membership is an auto-renewing subscription (currently $1.99/month) that grants early access and priority placement, billed through Stripe. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period and is not pro-rated. Prices and benefits may change with notice.

Affiliate & referral program

Every account receives a personal referral link. When someone makes a qualifying purchase through your link, you earn a 15% commission on that purchase for 6 months from their first order. Referrals are attributed by a tracking cookie that lasts 60 days from the click, and earned commissions are held for 20 days before they become payable, to allow for refunds, chargebacks, and returns.

  • You must have a valid account and use only your own referral link. Self-referrals, referrals to duplicate accounts you control, and your own purchases do not earn commission.
  • You may not promote your link through spam, misleading or deceptive claims, bidding on our brand or trademarks in paid search, cookie-stuffing, or any unlawful or abusive method. Violations may void affected commissions.
  • You are responsible for any taxes on commissions you earn. U.S. affiliates who reach the applicable reporting threshold may be required to provide tax information (for example, a W-9) and may receive a 1099.
  • Commissions are paid through our affiliate provider (Rewardful). We may withhold or reverse commissions tied to cancelled, refunded, fraudulent, or ineligible orders.
  • We may change the commission rate, attribution window, hold period, or other program terms, or suspend or end the program or your participation, at any time with reasonable notice.

Orders, pricing, payment & shipping

  • Prices are shown at checkout and may change over time. Payment is processed by Stripe.
  • We may refuse or cancel an order (for example, suspected fraud, errors, or stock issues) and will refund any charge for a cancelled order.
  • Returns and refunds are described in our Returns & Refunds policy, which forms part of these Terms.

Our designs & intellectual property

The Broadway Drop Shop LLC is an independent, fan-owned shop. Our products are original, transformative works created by fans and inspired by the theatre we love. They are not official merchandise and are not licensed by, affiliated with, sponsored by, or endorsed by any production, theatre, producer, rights holder, or other entity.

Where we reference a show by name, we do so only descriptively, to indicate the work that inspired a design — a nominative reference, not a claim of association. All show titles, logos, characters, and other trademarks or copyrighted material are the property of their respective owners. We do not reproduce protected logos or artwork, and we make no claim to any third-party intellectual property.

Our own designs, artwork, text, photographs, and the site itself are owned by The Broadway Drop Shop LLC or our licensors. You may not copy, resell, or create derivative works from them without our written permission.

Intellectual-property complaints

We respect intellectual-property rights and respond to valid complaints. If you believe a product or listing infringes your rights, email our support inbox with: a description of the work and the allegedly infringing item (with a link), your contact information, a statement of your good-faith belief, and your physical or electronic signature. We will review and, where appropriate, remove the item and act on repeat infringers, consistent with the DMCA and applicable law.

Your content

If you submit a custom-design request, review, or other content, you confirm you have the right to share it and grant us a non-exclusive, royalty-free license to use it for the purpose of providing and promoting the Shop. Do not submit content that infringes others’ rights or that you are not permitted to share.

Acceptable use

You agree not to misuse the Shop — including attempting to bypass the queue, scrape or overload the site, interfere with security, or use it for unlawful purposes.

Disclaimers & limitation of liability

The Shop is provided “as is” without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, The Broadway Drop Shop LLC will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. You agree to indemnify us against claims arising from your misuse of the Shop or violation of these Terms.

Governing law & changes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction of the state and federal courts located in New York. We may update these Terms from time to time; material changes will be posted here with a new “Last updated” date, and your continued use means you accept them.
